The short answer
No state law sets who pays. The contract does.
The EPA tells buyers and sellers to settle the details early. It lists items to cover: how and where the test happens, who pays for it, what number triggers a fix, and who pays for the fix. We are not lawyers, so ask your agent or attorney to write the wording. Our job is to give you a clear test, a clear bid and a clear report to attach.
Common ways deals handle radon
Seller fixes before closing
The seller gets a bid, installs the system, and passes the post-install test results to the buyer.
Credit at closing
The seller lowers the price or gives a credit, and the buyer hires the installer.
Split the cost
Both sides share a written bid, with a cap.
Buyer accepts as is
The buyer takes the home with the number and plans the fix later. Get the test in writing first.

What Nebraska sellers must disclose
Nebraska requires sellers to give buyers a written disclosure that covers what they know about radon and whether the home was mitigated (Nebraska Real Estate Commission). If a test was done, hand it over. If you fix the home, hand over the post-install test too. Read our page on radon mitigation for a home sale for the timeline.
If you rent
Tenants cannot usually drill a floor or add a fan on their own. The EPA tenant guide says the owner must authorize the work (EPA Tenant's Guide). Test first, send the result in writing, and ask the landlord to hire a licensed company. See the radon testing and inspection page. Return to the home page any time.
Questions people ask us
Who pays for radon mitigation in Nebraska, the buyer or the seller?
The contract decides. The EPA says buyers and sellers should talk about test timing and about when and how mitigation happens and who pays for it.
Does a seller have to tell buyers about radon?
Yes. Nebraska requires a written disclosure of what the seller knows about radon; the form asks about radon gas and whether the home was mitigated (Nebraska Real Estate Commission).
Can a buyer ask for a new test?
Yes. The EPA says a buyer may ask for a new test if the last one is not recent, such as more than two years old, or if the home was renovated.
Who pays if I rent?
The EPA tenant guide says the owner has to authorize any work (EPA Tenant's Guide). Talk to your landlord in writing.
Can the buyer pay and get the cost back?
Some deals use a credit at closing or a price change. Ask your agent or attorney how to write it.
Who orders the work, buyer or seller?
Whoever the contract names. Many deals have the seller handle it before closing, but any plan works if both sides sign it.
